Sin embargo, al no existir norma que la obligue, la Sala reprochada debi\u00f3 aplicar en forma supletoria lo preceptuado en el art\u00edculo 126 del C\u00f3digo Procesal Civil y Mercantil. Esta Corte considera que el referido agravio no trasciende en el \u00e1mbito constitucional en afectaci\u00f3n de los derechos de la entidad amparista, porque el art\u00edculo 326 del C\u00f3digo de Trabajo indica que se deben aplicar normas supletorias cuando estas no contrar\u00eden el texto y los principios del C\u00f3digo. Asimismo, la norma que se pretende aplicar contradice lo establecido en el art\u00edculo ib\u00eddem, habida cuenta que en materia probatoria de despido, el C\u00f3digo citado no obliga a los trabajadores a presentar pruebas al respecto, de esa cuenta, no hace distinci\u00f3n entre el despido directo o indirecto, por lo que la inversi\u00f3n de la carga de la prueba opera en todos los casos de despido. Por esa situaci\u00f3n no se puede obligar al trabajador a demostrar sus proposiciones.\u00a0<\/p><p>Ante los motivos expuestos por el Tribunal reclamado, esta Corte manifiesta que de acuerdo al art\u00edculo 80 del C\u00f3digo de Trabajo, cuando el empleado le comunique al patrono que se da por despedido indirectamente, este goza del derecho de emplazar al trabajador ante los Tribunales de Trabajo y Previsi\u00f3n Social con el objeto de probar que abandon\u00f3 sus labores sin justa causa y, si el patrono prueba esto \u00faltimo, ser\u00e1 el empleado quien le pague a este el importe del preaviso y los da\u00f1os y perjuicios que haya ocasionado. Esto es importante destacarlo, porque en todo caso, la entidad postulante tuvo la oportunidad de probar que la ex trabajadora abandon\u00f3 sin justa causa sus labores ocasion\u00e1ndole un perjuicio que debi\u00f3 ser reparado, situaci\u00f3n que no aconteci\u00f3, por lo que la Sala haciendo uso del principio jur\u00eddico Iura Novit Curia, labor intelectiva que es propia<br \/>del ejercicio de la funci\u00f3n jurisdiccional que le confiere la Constituci\u00f3n Pol\u00edtica de la Rep\u00fablica de Guatemala y dem\u00e1s leyes de trabajo, determin\u00f3 que aunque no existe norma espec\u00edfica que disponga, en el caso de despido indirecto, qui\u00e9n tiene la carga de la prueba, la ley de la materia no hace distingo entre despido directo o indirecto con relaci\u00f3n a este aspecto, por lo que este principio debe aplicarse en todos los casos en que concurre un despido, caso contrario, la norma laboral exigir\u00eda expresamente el aporte de prueba por parte del actor en los casos de despido indirecto, lo que no sucede en ninguna parte de su articulado. Asimismo,<br \/>como ha quedado demostrado, la ahora amparista no aport\u00f3 ning\u00fan medio de prueba que sirviera para eximir su responsabilidad en el despido indirecto alegado por la actora, tal y como manifiesta la ley de la materia.
